BENGAL CAT/KITTEN PURCHASE AGREEMENT AND HEALTH GUARANTEE
This agreement between the owner of My Exotic Cats, (Seller) and _________________________________, (Buyer/Purchaser). By giving MY EXOTIC CATS form of payment for purchase of cat/kitten(s) Buyer has accepted terms of the MY EXOTIC CATS contract. All kitten/cat sales through MY EXOTIC CATS are covered by the terms of kitten/cat contract of sale regardless of signature(s). Agreement may be verbal, electronic or written. It is the Buyer's responsibility to review terms of contract.

All MY EXOTIC CATS MUST leave in a carrier. A $30 fee will be required if Seller must provide a carrier for cat to leave. If Buyer is unable to take possession of the above said kitten/cat on the pick-up date agreed upon by both Buyer and Seller, an allotted grace period of two weeks will be given to reschedule a pick- up date and time convenient for both parties. If the Buyer cannot pick-up the kitten/cat within the two- week grace period Buyer will forfeit the above kitten/cat and any monetary amount paid towards it will be credited forward towards a future purchase. If buyer kitten/cat dies from unforeseen circumstances before Buyer takes possession of kitten/cat, then the non-refundable deposit will be credited forward towards another kitten/cat when a future kitten/cat is available. All deposits are nonrefundable but may be credited forward at the Seller’s discretion.
Purchaser/Buyer agrees to ALL of the following:
1.) Under no circumstances will this kitten/cat ever be sold or given away to wholesaler/s, retailer/s, be donated for a raffle, abandoned or be placed in any shelter or refuge type facility. If Purchaser becomes unable to keep this kitten/cat FOR ANY REASON Buyer agrees to return kitten/cat to MY EXOTIC CATS to be placed in a selective home. There will be NO cash refunds upon return. Kitten/Cat may NOT be resold unless written permission is given by Seller.
2.) This kitten/cat shall NOT be allowed to roam outdoors freely at any time.
3.) If this kitten/cat is being purchased with Breeder/Show rights. Breeding/Show rights are granted gratuitously and with no potential guarantees of any kind, due to the many factors involved in rearing and caring for this kitten that are beyond the control of the Seller. Kitten/cat must be spayed/neutered upon retirement and may only be rehomed AFTER SPAY/NEUTER.
Breeding/show rights are non-transferable to third parties at any time during the life of said kitten/cat. Kitten/cat is not at any time permitted to participate in breeding at a third-party residence or in third party possession. Male cats may not be studded out and all kittens produced by the cat specified in this contract will be sold as pets only. Permission to reproduce the My Exotic Cats bloodline is extended to the Buyer ONLY and not beyond, or through future kittens with third parties.
4.) If kitten/cat is being sold as a companion quality pet on a spay/neuter contract, Buyer agrees to spay/neuter kitten/cat before 6 months of age and provide veterinary proof of spay/neuter. Upon receiving proof of spay/neuter, Seller agrees to promptly mail or email the kitten/cat’s blue slip/TICA registration. If said kitten/cat is not spayed/neutered by 6 months of age, the kitten will become a breeding cat and MY EXOTIC CATS will promptly bill the buyer for the remaining balance; standard breeder rates are double the price of a companion quality pet. If the kitten is being sold with Breeder/Show rights, the kitten/cat’s blue slip/TICA registration will be provided at time of purchase unless otherwise agreed by both Buyer and Seller.
5.) Purchaser agrees to provide immediate veterinary attention to the kitten/cat upon any signs of illness or distress. Seller will not pay any veterinary bills unless agreed to in advance and in writing.
6.) Purchaser states that there are no pesticide treatments or programs known to be harmful to animals, used in the residence where this kitten/cat will reside.
7.) Purchaser has examined this kitten/cat and it appears to be in good health and free of parasites.
8.) If this cat/kitten is found to be neglected or mistreated the Purchaser will surrender this cat/kitten to MY EXOTIC CATS unconditionally. No refund of purchase price will be given.
9.) Purchaser agrees that if there should be legal action in regard to this cat/kitten, the Purchaser will be responsible for all legal fees, including Seller’s attorney cost, interest and cost of action. All legal action must be held in the Seller’s current city and state, Sunbury, Ohio, Delaware County.
10.) This contract shall be deemed a legal binding document between two parties (Buyer/Purchaser and Seller) regardless of signature, once kitten is purchased, all rights and guarantees are NON-TRANSFERABLE. Purchaser is also aware that all proceedings, including disputes, with MY EXOTIC CATS are to remain between Purchaser and Seller.
Two Year Health Guarantee:
The above kitten/cat is guaranteed to be in good health upon delivery. Buyer (at buyer's expense) must have this kitten/cat checked by a licensed veterinarian within 2 business days following the purchase/possession date. If the kitten/cat is not checked by a license veterinarian by the date listed above, this two-year health guarantee is no longer valid, and all terms of the health guarantee shall become null and void effective immediately. This contract does not provide guarantees against Coccidia, giardia, URIs, Worms, Fleas, Ticks, Ear mites, Ringworm and other minor parasites that happen with kitten /cats and are not life threatening.
If the kitten/cat has been found to have a life-threatening problem, untreatable genetic disease or birth defect within twenty-four months of the purchase date, Buyer must notify Seller with a veterinarian certification in writing of exact nature of defect within 24 hours of disclosure of problem. Under no circumstances may this kitten/cat be euthanized if a condition is treatable or without permission from Seller. If kitten/cat dies during treatment or suddenly, replacement will only be made after a licensed veterinarian has certified that the exact cause of death was related to an untreatable genetic disease or birth defect.
An appropriate necropsy must be performed by a licensed veterinarian and a veterinarian’s certificate with full disclosure including a copy of the necropsy report must be provided with proof of cause of death. In addition, the veterinarian must send a sample of said kitten/cat’s DNA with a signed photograph of the kitten to Seller in order to confirm that the kitten/cat is in fact the one covered by this health guarantee. Trauma, abuse, neglect, failure to provide adequate veterinary care, or failure to provide the required veterinary documentation will void the opportunity for replacement.
The kitten/cat will be replaced up to two years of age if the veterinarian finds this kitten/cat to have a deadly congenital health defect of the heart, including but not limited to HCM.
Buyer agrees to never have this kitten/cat vaccinated for FIP. It has been proven to predispose a Bengal kitten/cat to this disease once the vaccine has been given. If the FIP vaccination are given to said kitten/cat, this health guarantee is voided immediately. FELV vaccinations are best given after 6 months of age as Bengal kittens have been known to have inflammatory responses to the vaccine.
Buyer agrees to use killed or modified-live vaccinations. If live (not modified-live) vaccinations are administered to said kitten or cat, this health guaranteed is immediately void.
If kitten/Cat is given Ketamine anesthetic, for spay/neuter or any other surgical procedure, this health guarantee is immediately void.
To ensure a smooth transition into kitten/cat’s new home, keep feeding the kitten/cat Purina Pro Plan Kitten Focus. DO NOT CHANGE FOOD. A kitten will not be exchanged or replaced due to stomach upset.
NO CASH REFUNDS. The kitten/cat will be exchanged for another of equal value when one is available provided a letter from the veterinarian is given as evidence of the kitten's/cat's congenital defect and the kitten/cat is returned to Seller along with all the TICA and pedigree papers. Any shipping and/or veterinarian expenses are the sole responsibility of the Buyer. Replacement must be claimed as soon as a replacement if offered. Seller reserves the right to refuse any further extension if Buyer fails to accept a kitten/cat offered as a replacement.
Once replacement kitten/cat is in Buyer’s possession, replacement kitten/cat CAN NOT be transferred by sale or gift to a third party. If replacement kitten/cat is not wanted by Buyer any time after taking possession of kitten/cat, the kitten/cat MUST be returned to Seller at Buyer’s expense.
Legality Issues:
By giving MY EXOTIC CATS form of payment for purchase of cat/kitten(s) you have accepted terms of our contract. All kitten/cat sales through MY EXOTIC CATS are covered by the terms of contract regardless of signature(s). Agreement may be verbal, electronic or written as to include out of state buyers who must ship their kittens. It is the buyer’s responsibility to review terms of this contract.
Seller has no immediate plans to discontinue breeding Bengal cats but guarantees and warranties are only valid as long as kittens are still being produced.
Buyer is responsible for checking local and state hybrid laws regarding the legality of the hybrid breed. Seller is not responsible for any legal fees or fines acquired once a hybrid is purchased by buyer.
If this contract is breeched for any reason the Purchaser is required to return cat/kitten to MY EXOTIC CATS immediately at Purchaser’s expense. Seller is able to bring legal action against Purchaser of said kitten is Bred/Shown without Breeder/Show rights, in the amount of $3,000.00 per infraction.
Advertising Rights:
Seller reserves the right to use any photos of the purchased kitten/cat in any and all advertising, included but not limited to internet, website, and social media. Buyer agrees to allow Seller to use photos/videos of his/her kitten/cat in existing or future advertising.
